PRIVACY POLICY
We recognize that your privacy is very important and take it seriously. This Privacy Policy describes Clive’s policies and procedures on the collection, use and disclosure of your information when you use the Clive Service. It also includes in phone or email interactions you have with us. If you live in Canada, please read our Canadian Privacy Policy. We will not use or share your personal information with anyone except as described in this Privacy Policy. This Privacy Policy does not apply to personal information we collect by other means (including offline) or from other sources. Capitalized terms that are not defined in this Privacy Policy have the meaning given them in our Terms of Service.
Information Collection and Use
Clive uses personal information we collect to provide the Service, analyze how the Service is used, diagnose service or technical problems, maintain security, personalize content, remember information to help you efficiently access your account, monitor aggregate metrics such as total number of visitors, traffic, and demographic patterns, and track User Content and users as necessary to comply with the Digital Millennium Copyright Act and other applicable laws.
User-Provided Information
When you register for a member account with the Service, buy a ticket or have a ticket transferred to you by a friend, we will collect your contact and billing information, such as your name, street address, zip code, email, phone number and credit card number. Your name and other information you choose to add to your profile will be available for public viewing on the Service. We may use your information to process your order, provide you with customer support, or send you Service-related notices (including any notices required by law, in lieu of communication by postal mail). This includes sending you emails about your account or a ticket purchase. We might also contact you about this policy or our website terms. You can control receipt of certain Service-related messages in your Settings page. We may also use your information for marketing purposes. For example, we might send you information about special promotions or offers. We might also tell you about new features or products. These might be our own offers or products, or third-party offers or products we think you might find interesting. Or, for example, if you buy tickets from us we’ll enroll you in our newsletter, or in one or more of our affiliates’ newsletters.
If you do not want to receive such messages, you may opt out by following the instructions in the message. If you correspond with us by email, we may retain the content of your email messages, your email address and our responses. You can also change your preferences in your account. It may take about ten days to process your request. Even if you opt out of getting marketing emails, we will still be sure to send you transactional messages. For example, we may still contact you about your orders.
To correct or delete information or update account settings, log into your account and follow the instructions. We make changes as soon as we can. This information may stay in our backup files. If we cannot make the changes you want, we will let you know and explain why. If you contact us requesting access to your information, we will respond within 45 days.
You also provide us information in User Content you post to the Service. Your questions, answers, and other contributions on the Service, and metadata about them (such as when you posted them), are publicly viewable on the Service, along with your name (unless the Service permits you to post anonymously). This information may be searched by search engines and be republished elsewhere on the Web in accordance with our Terms of Service.
If you choose to use our invitation service to invite a friend to the Service, we will ask you for that person’s email address and automatically send an email invitation. Clive stores this information to send this email, to register your friend if your invitation is accepted, and to track the success of our invitation service. We will only use your friend’s information to provide services you requested. Your friend may contact us at privacy@clive.net to ask us to delete their information.
Cookies
When you visit the Service, we may send one or more “cookies” – small data files – to your computer to uniquely identify your browser and let Clive help you log in faster and enhance your navigation through the site. A cookie may convey anonymous information about how you browse the Service to us but does not collect personal information about you. A persistent cookie remains on your computer after you close your browser so that it can be used by your browser on subsequent visits to the Service. Persistent cookies can be removed by following your web browser’s directions. A session cookie is temporary and disappears after you close your browser. You can reset your web browser to refuse all cookies or to indicate when a cookie is being sent. However, some features of the Service may not function properly if the ability to accept cookies is disabled.
Log Files
Log file information is automatically reported by your browser each time you access a web page. When you use the Service, our servers automatically record certain information that your web browser sends whenever you visit any website. These server logs may include information such as your web request, Internet Protocol (“IP”) address, browser type, referring / exit pages and URLs, number of clicks, domain names, landing pages, pages viewed, and other such information.
Clear GIFs Information
When you use the Service, we may employ clear GIFs (also known as web beacons) which are used to track the online usage patterns of our users anonymously. No personally identifiable information from your Clive account is collected using these clear GIFs. In addition, we may also use clear GIFs in HTML-based emails sent to our users to track which emails are opened by recipients. The information is used to enable more accurate reporting and make Clive better for our users.
Third-Party Services
Clive may use Google Analytics or Mixpanel to help understand use of the Service. Google Analytics and Mixpanel collect the information sent by your browser as part of a web page request, including cookies and your IP address. Google Analytics and Mixpanel also receive this information and their use of it is governed by their Privacy Policies.
We may share information with third parties who perform services on our behalf. For example, we may share information with vendors who help us manage our IT infrastructure or who fulfill your purchases. Some vendors may be located outside of the United States.
We may share information with our business partners. This includes a third party who provides an event such as the artist, promoter or team, or sponsors an event, or who operates a venue where we hold events. Our partners use the information we give them as described in their privacy policies, which may include sending you marketing communications. You should read those policies to learn how they treat your information.
Account Registration
In order to access certain features of the Site and Application, and to book a Creative, you must register to create an account (“Clive Account”) and become a Member. You may register to join the Services directly via the Site or Application or as described in this section.
You can also register to join by logging into your account with certain third-party social networking sites (“SNS“) (including, but not limited to, Facebook; each such account, a “Third-Party Account”), via our Site or Application, as described below. As part of the functionality of the Site, Application and Services, you may link your Clive Account with Third-Party Accounts, by either: (i) providing your Third-Party Account login information to Clive through the Site, Services or Application; or (ii) allowing Clive to access your Third-Party Account, as permitted under the applicable terms and conditions that govern your use of each Third-Party Account. You represent that you are entitled to disclose your Third-Party Account login information to Clive and/or grant Clive access to your Third-Party Account (including, but not limited to, for use for the purposes described herein), without breach by you of any of the terms and conditions that govern your use of the applicable Third-Party Account and without obligating Clive to pay any fees or making Clive subject to any usage limitations imposed by such third-party service providers. By granting Clive access to any Third-Party Accounts, you understand that Clive will access, make available and store (if applicable) any Content that you have provided to and stored in your Third-Party Account (“SNS Content“) so that it is available on and through the Site, Services and Application via your Clive Account and Clive Account profile page. Unless otherwise specified in these Terms, all SNS Content, if any, will be considered to be Member Content for all purposes of these Terms. Depending on the Third-Party Accounts you choose and subject to the privacy settings that you have set in such Third-Party Accounts, personally identifiable information that you post to your Third-Party Accounts will be available on and through your Clive Account on the Site, Services and Application. Please note that if a Third-Party Account or associated service becomes unavailable or Clive’s access to such Third-Party Account is terminated by the third-party service provider, then SNS Content will no longer be available on and through the Site, Services and Application. You have the ability to disable the connection between your Clive Account and your Third-Party Accounts, at any time, by accessing the “Settings” section of the Site and Application. PLEASE NOTE THAT YOUR RELATIONSHIP WITH THE THIRD-PARTY SERVICE PROVIDERS ASSOCIATED WITH YOUR THIRD-PARTY ACCOUNTS IS GOVERNED SOLELY BY YOUR AGREEMENT(S) WITH SUCH THIRD-PARTY SERVICE PROVIDERS. Clive makes no effort to review any SNS Content for any purpose, including but not limited to for accuracy, legality or non-infringement and Clive is not responsible for any SNS Content.
We will create your Clive Account and your Clive Account profile page for your use of the Site and Application based upon the personal information you provide to us or that we obtain via an SNS as described above. You may not have more than one (1) active Clive Account. You agree to provide accurate, current and complete information during the registration process and to update such information to keep it accurate, current and complete. Clive reserves the right to suspend or terminate your Clive Account and your access to the Site, Application and Services if you create more than one (1) Clive Account or if any information provided during the registration process or thereafter proves to be inaccurate, not current or incomplete. You are responsible for safeguarding your password. You agree that you will not disclose your password to any third party and that you will take sole responsibility for any activities or actions under your Clive Account, whether or not you have authorized such activities or actions. You will immediately notify Clive of any unauthorized use of your Clive Account.
How We Share Your Personally Identifiable Information
Clive may share your personally identifiable information with third parties for the purpose of providing the Service to you. If we do this, such third parties’ use of your information will be bound by this Privacy Policy. We may store personal information in locations outside the direct control of Clive (for instance, on servers or databases co-located with hosting providers).
As we develop our business, we may buy or sell assets or business offerings. Customer, email, and visitor information is generally one of the transferred business assets in these types of transactions. We may also transfer or assign such information in the course of corporate divestitures, mergers, or dissolution.
We may share or disclose your information with your consent, such as if you choose to sign on to the Service through a third-party service. We cannot control such third parties’ use of your information.
Clive may disclose your personal information if required to do so by law or subpoena or if we believe that it is reasonably necessary to comply with a law, regulation or legal request; to protect the safety of any person; to address fraud, security or technical issues; or to protect Clive’s rights or property.
You also may give us permission to access your information in other services. For example, you may link your Facebook, Twitter or Instagram account to Clive, which allows us to obtain information from those accounts (like your friends or contacts). The information we get from those services often depends on your settings or their privacy policies, so be sure to check what those are. For example, if you sign up using a Facebook account, we may help your Facebook friends find your account on Clive when they first sign up for Clive.
Link or unlink your Clive account from an account on another service (e.g., Facebook, Twitter or Instagram). For some services (like Facebook), you can also choose whether or not to publish your activity on Clive to that service.
How We Share Your Non-Personally Identifiable Information
We may share non-personally identifiable information (such as anonymous usage data, referring/exit pages and URLs, platform types, number of clicks, etc.) with interested third parties to help them understand the usage patterns for certain Clive services.
Clive may allow third-party ad servers or ad networks to serve advertisements on the Service. These third-party ad servers or ad networks use technology to send, directly to your browser, the advertisements and links that appear on Clive. They automatically receive your IP address when this happens. They may also use other technologies (such as cookies, JavaScript, or web beacons) to measure the effectiveness of their advertisements and to personalize the advertising content. Clive does not provide any personally identifiable information to these third-party ad servers or ad networks without your consent. However, please note that if an advertiser asks Clive to show an advertisement to a certain audience and you respond to that advertisement, the advertiser or ad server may conclude that you fit the description of the audience they are trying to reach. The Clive Privacy Policy does not apply to, and we cannot control the activities of, third-party advertisers. Please consult the respective privacy policies of such advertisers for more information.
How We Protect Your Information
Clive uses commercially reasonable physical, managerial, and technical safeguards to preserve the integrity and security of your personal information. We cannot, however, ensure or warrant the security of any information you transmit to Clive or guarantee that your information on the Service may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. However, the Internet is not 100% secure. We cannot promise that your use of our sites will be completely safe. If you think that an unauthorized account has been created using your name, contact us at the address below.
In the event that personal information is compromised as a result of a breach of security, Clive will promptly notify those persons whose personal information has been compromised, in accordance with the notification procedures set forth in this Privacy Policy, or as otherwise required by applicable law.
If you live outside of the United States, you understand and agree that we may transfer your information to the United States. This site is subject to United States laws, which may not afford the same level of protection of those in your country.
We may link to third party sites or services we don’t control. If you click on one of those links, you will be taken to websites we do not control. This policy does not apply to the privacy practices of those websites. Read the privacy policy of other websites carefully. We are not responsible for these third party sites. Our site may also serve third-party content that contains their own cookies or tracking technologies. We do not control the use of those technologies.
Your Choices About Your Information
You may, of course, decline to submit personally identifiable information through the Service, in which case Clive may not be able to provide certain services to you. You may update or correct your account information and email preferences at any time by logging in to your account.
Children’s Privacy
Protecting the privacy of young children is especially important. Clive does not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register with the Service. If we become aware that we have collected personal information from a child under age 13 without verification of parental consent, we take steps to remove that information.
Links to Other Websites
We are not responsible for the practices employed by websites linked to or from the Service, nor the information or content contained therein. Please remember that when you use a link to go from the Service to another website, our Privacy Policy is no longer in effect. Your browsing and interaction on any other website, including those that have a link on our website, is subject to that website’s own rules and policies.
Changes to Our Privacy Policy
From time to time we may change our privacy practices. If we change our privacy policies and procedures, we will notify you of any material changes to this policy as may be required by law. We will also post an updated copy on our website. Changes to this Privacy Policy are effective when they are posted on this page. Please check our site periodically for updates.
